Part 3 and our final piece of DWI advice is the following:
You do not have to do the breath test. You can simply say “I respectfully choose to not do the breath test”. The Police can request a court order for a blood test and you cannot refuse the blood test but sometimes they do not request the blood draw, which can help you case.
Too many times, we have seen that people will unconsciously do things to help the law enforcement officers case against you. All of our pieces of advice are fully within your legal rights and will give you the best chance at wining your case if you are ever put in this situation. If you have any questions please feel free to ask us.
